The increasing digitalisation of relationships has driven the development of new forms of dispute resolution tailored to the digital environment. Online Dispute Resolution (ODR) has established itself as an evolution of alternative dispute resolution (ADR) methods, incorporating technological tools that enable disputes to be managed via electronic platforms. This paper analyses the phenomenon of ODR, its concept, regulatory framework and main advantages, although its implementation also poses various legal challenges, amongst which we highlight the guarantee of the right to effective judicial protection, the identification of parties in digital environments, the protection of personal data, the digital divide, and the validity and enforcement of agreements. Furthermore, the growing use of artificial intelligence tools raises new questions regarding the permissible degree of automation in dispute resolution.
