This article analyzes the legal challenges faced by transgender children within the Ecuadorian education system, focusing primarily on the family’s role as protector of the right to education within the context of gender diversity. Using a hermeneutical methodology that incorporates doctrine, jurisprudence, and legal norms, this academic research aims to identify both the normative and structural gaps that hinder the recognition of gender identity in children and adolescents in the school setting, and to propose concrete legal guidelines for addressing them. While the article centers on the Ecuadorian context, it draws on comparative references, which lend coherence to the national legal framework and propose criteria for the education system to respect gender identity and strengthen the protective role of families. As a result, the articulation between family co-responsibility and the obligations of the State allows for the establishment of a constitutional standard that guarantees the comprehensive development of transgender children and recognizes their right to education. In conclusion, this leads to the creation of safe environments where trans children can have full recognition of their identity and dignity, without being subject to any threat from the educational environment.
