This article examines the rules governing creditor standing to submit an independent report on the fraudulent nature of the insolvency (concurso culpable), as introduced by the amendment to article 449 of the Consolidated Spanish Insolvency Law effected by Law 16/2022. To that end, it focuses on the relationship between this mechanism and the observations procedure available during the claims filing period provided for under article 447 of the Consolidated Spanish Insolvency Law. In particular, the article considers the following issues: whether the observations procedure is a procedural prerequisite for the subsequent submission of an independent classification report; whether the content of the observations determines the scope and content of the report; and how the courts should handle newly discovered facts that come to a creditor’s attention after the deadline for filing claims has expired. The analysis is conducted in light of the principles established by judgment 28/2025 of 14 February of the Eighth Chamber of the Court of Appeal of Alicante (Roj: SAP A 87/2025), which addresses many of the issues examined in this case.
