The 2018 Amendment to the Barcelona Metropolitan General Urban Development Plan introduced a requirement that 30% of the buildable area designated for multi-family residential use in certain new-build and major refurbishment developments on consolidated urban land be designated to publicly protected housing. This measure raises two important legal issues: whether planning instruments may require that buildable floor area in developments in existing buildings be reserved for protected housing, and whether the imposition of such a requirement gives rise to a right to compensation. In this regard, Spanish Supreme Court judgment 110/2026 of 5 February confirms that planning instruments may require that a proportion of the buildable residential floor area on consolidated urban land be reserved for protected housing, including in building operations as defined in article 7.2 of the Spanish Land Law. However, the Court held that this obligation does not automatically give rise to a right to compensation, notwithstanding specific cases where an actual interference with vested property rights is established.
