If sector-specific regulations governing consumer contracts must respect the minimum level of protection established by their own legislation, it is necessary to examine how the regulations governing electricity and natural gas supply contracts interpret their obligation to comply with the minimum protection requirements of that legislation. Specifically, we will refer to their different provisions regarding penalties for the early termination of these supply contracts when requested by the contracting consumer before the end of the first year. The ultimate goal is to verify the varying degrees of compatibility between their respective methods of demanding such penalties and the mandatory parameters established by Articles 62.3 and 87.6 of the Spanish General Law for the Defense of Consumers and Users (TRLGDCU), which essentially coincide with the restrictive requirements that the Electricity and Gas Directives impose on their contractual application.
