This paper analyses the current criteria for the attribution of the use of the family home following marital breakdown, as provided for in Article 96 of the Spanish Civil Code. In particular, it examines whether the reform introduced by Law 8/2021 has resolved the main controversial issues that had arisen under the previous wording of the provision and whether, from this perspective, the reform may be regarded as satisfactory. The paper also studies the specific protection afforded after the reform to persons with disabilities, a matter on which the former wording of Article 96 contained no express provision.
