En el presente trabajo abordo analíticamente algunos puntos de la reciente reforma al régimen previsional de la Caja de Jubilaciones, Subsidios y Pensiones del Personal del Banco de la Provincia de Buenos Aires. Específicamente, efectúo una selección de ciertos institutos de la Ley 15.514, a saber, edad jubilatoria, acumulación de prestaciones, determinación del haber de inicio, reajuste de haberes y movilidad. Para el análisis, recurro a fuentes legales vigentes y no vigentes, así como también a la jurisprudencia. Luego del estudio individual de aquellos puntos, y en el campo de la visión global de la nueva ley y conclusiones, explicito que, según mi parecer, la reciente reforma tiene aspectos que mejoraron el régimen anterior, pero también algunos otros que debieran seguir trabajándose.
In this paper, I analytically address several points of the recent reform to the pension system of the Retirement, Subsidy, and Pension Fund for Personnel of the Bank of the Province of Buenos Aires. Specifically, I select certain provisions of Law 15.514, namely, retirement age, benefit accrual, determination of the starting salary, salary readjustment, and mobility. For the analysis, I draw on current and outdated legal sources, as well as case law. After an individual study of these points, and within the scope of the new law and conclusions, I explain that, in my view, the recent reform has aspects that improved the previous system, but also some others that should continue to be worked on.
