This paper analyzes the relationship between intelligence activities and the protection of fundamental rights within a multilevel legal system in the context of countering transnational crime. Specifically, the study examines the limitations of the repressive model in comparison to a human rights-based approach. To this end, the research begins by investigating international and European norms and jurisprudence concerning the legitimacy of potential derogations and exceptions to human rights for security purposes. Subsequently, it illustrates the prospects for reforming the European information architecture in light of the Niinistö Report and recent regulatory initiatives concerning the INTCEN, highlighting the risk of a supranational judicial oversight deficit to the detriment of individual guarantees.
