This paper analyses Galician High Court Judgment 233/2026, of 23 April, concerning an award in an administrative auction in which the taxable base for Transfer Tax is determined by the property’s reference value, which is higher than the price actually paid by the purchasers. Based on Constitutional Court Judgment 13/2026, which declared this system constitutional, the paper examines its effects on the principle of economic capacity, the burden of proof, individualized verification and taxpayer guarantees. The commentary argues that the case reveals the risks of making the reference value the prevailing metric when there are unique data, such as the auction award price, that reflect a different economic reality. The critique is primarily directed at the legal design of the system and the scope of its constitutional backing
