This essay examines the legal framework of civic uses (usi civici) in light of recent case law, focusing on the presumption of demanial status as a mechanism of enhanced protection for collective property. It argues that such presumption is not merely evidential but reflects a broader policy choice aimed at preserving the collective destination of the asset and its environmental function, in line with Articles 9 and 42 of the Italian Constitution. The paper also considers the role of the Commissioner for civic uses and the relationship between civic lands and energy infrastructure, highlighting the limits to encroachments on collective rights in the absence of a proper legal basis. A systematic approach is adopted to emphasise the need to balance infrastructural development with the protection of collective assets.
