The energy transition process has increased the demand for rural land for the deployment of renewable energies, raising significant legal challenges. In this context, the right of surface (derecho de superficie) emerges as an ideal instrument for developing energy infrastructures without altering the underlying land ownership. This paper analyzes its legal configuration from a normative, doctrinal, and jurisprudential perspective. It highlights its capacity to separate land ownership from the ownership of the installations, thereby guaranteeing legal certainty for the parties and enabling the creation of other rights in rem. This legal division specifically makes possible the constitution of real security interests over the surface right itself (surface mortgage), which are essential for financing these infrastructures.
Furthermore, a proper drafting of the deed of incorporation will allow, in certain cases, the compatibility of agricultural and livestock use with energy production, contributing both to the energy transition and the maintenance of farming and livestock production.
