The decision of the Spanish Data Protection Authority declaring the incompatibility between the role of Data Protection Officer and the person responsible for the internal reporting system is one of the first relevant decisions on the relationship between the GDPR and Spanish Act 2/2023. This comment argues that the substantive conclusion is reasonable, but that the real problem is one of competence: the matter has been settled by the data protection authority owing to the silence of the specialised authorities —the Independent Whistleblower Protection Authority and its regional counterparts— which have regulated the reporting system officer in detail without addressing its relationship with the Data Protection Officer.
