Guidelines 1/2026 aim to promote research whilst safeguarding fundamental rights. However, they have limitations due to their restrictive approach to the definition of research, the governance of data infrastructures, the interpretation of the principle of purpose limitation, and anonymisation. This approach could hinder innovation and competitiveness in the scientific and business sectors. Whether they like it or not, the authorities must look themselves in the mirror when it comes to responsibility and accountability, and recognise that they will be held accountable for the economic, strategic and geopolitical impact of their decisions. It is therefore more urgent than ever to hold a cross-sectoral debate that strikes a balance between data protection, freedom of research and the EU’s strategic objectives.
