Undoubtedly, the «star» issue of recent times has been the almost impossibility of processing biometric data, as there is no possibility of lifting the prohibition of article 9.1 of the GDPR and this type of processing is not contemplated in our legal system. There are already many responsible parties fined, but there are also some who have managed to have the claims filed. Two of these resolutions have been analysed.
In the rest of this article, we address issues that affect the workplace, such as the fact that workers should not be asked for their private mobile phone, and the transfer of images from a third party to serve as evidence to process a disciplinary file against a worker, as well as the surprising response given by a person in charge to the first request for information made by the Agency.
