This article aims to analyze the scope of application of the general rule of the Chilean Code of Criminal Procedure that prohibits incorporating, invoking or reading records or documents of the investigation, examining its two exceptions (use as evidence and as a mechanism for refreshing memory), the use of records or prior statements other than those authorized in article 332 and the rules that enable the production of evidence on evidence. To this end, we review the history of the rules, the main positions of national and international doctrine and propose an interpretation compatible with safeguarding the centrality of the oral trial in the criminal process. It is concluded that the Chilean criminal procedural system has found a balance between the general prohibition of incorporating information produced outside the oral trial and reasonable exceptions that, interpreted restrictively, allow for the entry of relevant information generated by the parties in litigation during the preparatory investigation stage.
