This paper examines the origin and systemic structure of fundamental rights through the theory of penumbras, emphasizing how unenumerated rights contribute to the internal coherence of the constitutional system. Through a critical review of U. S. case law, especially Griswold v. Connecticut, it shows that the protection of certain legal interests depends on an architecture of interconnected rights, beyond their isolated textual formulation. It argues that, within this framework, constitutional interpretation requires a structural and dynamic reading in which explicit and implicit rights reinforce one another. Accordingly, the justification of rights not expressly recognized is grounded in the need to preserve the consistency and functionality of the U. S. constitutional system.
