This paper first examines the notion of the insured event in liability insurance as adopted by case law, given its significant impact on the action for performance that may be brought by the insured under this type of insurance as a result of the materialisation of the harmful event. To this end, the avenues available to the injured party to obtain compensation for the damage for which the insured is civilly liable are outlined, followed by a critical analysis of the recent and controversial judicial decisions concerning the conditions that must be met for asserting the aforementioned action for performance.
