Housing is one of the most pressing issues facing the spanish welfare state. The housing crisis that affects a wide range of the spanish society has led to the adoption of the first national law developing the article 47 of the spanish Constitution. The text has received mixed reviews from both legal practitioners and doctrine. This article offers a critical analysis of its main innovations: the creation of a standardized legal framework guaranteeing access to decent and adequate housing, the incorporation of concepts such as “large-scale owner” and “high-demand area”, and the reconciliation of the essential elements of the right to property with the limitations arising from the broad interpretation of the social function of property.
