This study examines the main arguments shared by those constitutional juris-dictions that have concluded that assisted dying is constitutional and/or that its prohibition is unconstitutional (Colombia, Canada, Italy, Germany, Austria, Portugal, Spain and Ecuador) and the ECtHR. Four arguments are analysed: free and responsible self-determination with regard to one’s own death, the impossibility of imposing a duty to live in situations of unbearable suffering caused by illness, the consistency of the legal system in matters of end-of-life decisions, and the progressive reinterpretation of the right to life as a guarantee of physical existence.
