As recently as April 14, the CJEU (Grand Chamber) issued a judgment in case C-418/24 (Obadal case) in which it examines the measures adopted by the State in Law 28/2021, of December 28, on urgent measures to reduce the temporality in public employment. This aims to provide a first analysis of this recent judgment, as well as its application by the 4th Chamber of the Supreme Court in the even more recent judgment of May 11, 2026 (rec. 3543/2023), and whether they have undergone any nuances in light of the contemporary judgment of the 10th Chamber of the CJEU of May 13, issued in case C-155/25. Finally, a reflection is required on the potential impact on administrative litigation, in light of the latest jurisprudential production of the 3rd Chamber of the Supreme Court.
