This paper examines the concept of undue influence in testamentary dispositions following the reform of Act 8/2021, analyzing the tension between testamentary freedom and the protection of vulnerable individuals. It advocates for a reinterpretation of Art. 753, shifting the focus from substituted decision-making to a system of supports and safeguards that ensure the authenticity of the testator’s intent
