Care for older persons is configured as an emerging legal reality which, despite its growing social and political relevance, still lacks a systematic articulation within Spanish civil law. Drawing on the constitutional and European framework, the insufficiency of assistance-based responses and the existing normative fragmentation are highlighted, as both hinder the effective legal protection of older persons. In response, the need to move towards a civil-law legal statute of care is advocated, conceived as a continuous and relational legal relationship focused on the autonomy and dignity of the older person. The main dogmatic, subjective and guarantee-related problems raised by this construction are identified, with particular emphasis on the difficulties involved in determining the subjects of care in situations of loneliness and family breakdown, as well as on the need for flexible and realistic civil-law solutions
