Article 382 bis of the Criminal Code is the result of responding to social demands, especially from cycling groups, considering the alleged increase in hit-and-run incidents involving victims. This paper discusses the urgency, justification and effectiveness of the offence of leaving the scene of the accident, or fleeing, in a contemporary criminal justice system. Through a substantive analysis of the offence, it first examines whether the classification of this new criminal offence complies with the legitimising and limiting principles of Spanish criminal law, specifically, those of subsidiarity, fragmentation and proportionality. Secondly, it reflects on the possibility that this offence against road safety lacks a protected legal interest. Finally, it highlights the shortcomings of this criminal offence which, in practice, may lead to an effect that is totally contrary to that intended. All this with the aim of verifying if criminal law has been used as a political tool to reassure the society without its real effectiveness having been proven.
