This article examines the evolution of the concept of gender over the last few decades and the increasing complexity of this analytical category in recent times. It highlights the importance of incorporating gender into human rights analysis, from critiquing androcentrism and the universal subject, to questioning the dichotomy and hierarchy between the public sphere (masculine and political) and the private sphere (feminine and natural), and criticizing a purely formal conception of equality that fails to lead to substantive equality by assuming the neutrality of law and human rights. In short, it emphasizes that the fundamental aspect of the relationship between gender and human rights is making visible the asymmetrical power relations that determine whether or not rights are upheld.
