La protección normativa del trabajo doméstico ha experimentado una evolución significativa que tambiénse ha hecho visible en el ámbito de la seguridad y salud de este colectivo de personas trabajadoras. Elreciente RD 893/2024, que desarrolla su derecho a la protección eficaz frente a los riesgos del trabajo,visibiliza la tensión existente entre la aspiración a equiparar la protección del personal doméstico alcomún de los trabajadores y la necesidad de dispensar al titular del hogar familiar de las cargas atribuiblesa todo empresario como deudor de seguridad. Por otra parte, la eficacia real de la norma es relativa enla actualidad ante la inacción de la propia Administración a la hora de dar cumplimiento a sus propiasprevisiones normativas.
Regulatory protection for domestic workers has undergone significant changes, which have also beenreflected in the area of health and safety for this group of workers. The recent Royal Decree 893/2024,which develops their right to effective protection against occupational risks, underscores the tensionbetween the aspiration to align the protection afforded to domestic workers with that of other workersand the need to exempt the head of the household from the obligations borne by employers as holders ofa duty of care in matters of safety. On the other hand, the actual effectiveness of the regulation remainslimited, given the Administration’s own failure to comply with its regulatory provisions.
