El presente artículo es resultado de una investigación cualitativa, descriptiva y analítica que aborda la digitalización del servicio notarial en Colombia y su relación con la congestión judicial. La investigación tiene como propósito comprender la incidencia de la digitalización de la función notarial en la forma en que se previenen conflictos y en las condiciones desde las cuales ciertos asuntos llegan al aparato judicial. Para el análisis de la información se tuvo como base los antecedentes y el marco normativo sobre función notarial, transformación digital y justicia preventiva en Colombia. Como resultado de la investigación se advierte que la digitalización introduce cambios en el funcionamiento del servicio notarial que transforman aspectos como la organización de la información, el aseguramiento de la autenticidad de los actos y sus posibilidades de verificación, variaciones que influyen en la forma de estructuración de las relaciones jurídicas y en cómo toman forma algunas controversias. Se concluye que la digitalización en el contexto notarial promueve la prevención de conflictos y la reducción de cargas judiciales evitables, con efectos que dependen de condiciones institucionales concretas, como consecuencia del fortalecimiento de la función notarial.
This article is the result of a qualitative, descriptive, and analytical research study that addresses the digitalization of notarial services in Colombia and its relationship with judicial congestion. The purpose of the research is to understand the impact of the digitalization of the notarial function on the way conflicts are prevented and on the conditions under which certain matters reach the judicial system. The analysis is based on prior studies and the regulatory framework concerning the notarial function, digital transformation, and preventive justice in Colombia. The findings indicate that digitalization introduces changes in the functioning of notarial services, transforming aspects such as information management, the assurance of authenticity in legal acts, and their possibilities for verification. These variations influence the way legal relationships are structured and how certain disputes take shape. It is concluded that digitalization in the notarial context promotes conflict prevention and the reduction of avoidable judicial burdens, with effects that depend on specific institutional conditions, as a result of the strengthening of the notarial function.
