The River Basin Committees develop Water Resources Plans, which include the classification of water bodies as well as the priorities for their use. These bodies intervene in the environmental licensing of polluting activities based on the Environmental Impact Statement (EIS), which, in the state of São Paulo, is the responsibility of CETESB. The objective of the article was to investigate the role of the Committees in state licensing, using as a method the analysis of regulations: SMA Resolution No. 054 of 2008 and CRH Deliberation No. 87 of 2008. It was found that the Committees have an advisory role in licensing, contributing with mitigation and compensation measures for impacts on water resources that may arise from developments. Considering their importance in water basin planning at the state level, it is suggested that the licensing authority be required to take the Committees' demands into account through prior consultations and at all stages of the environmental licensing process.
