The dignity of the human person, as an axiological basis of the legal system, underpins the provision of a series of rights enjoyed by all citizens. In other words, fundamental rights are based on the general clause of human dignity. This article addresses the most serious category of violation of such rights, the crime, and the main method of punishment provided by the State: imprisonment. We seek to present the legitimizing foundations of imprisonment as a punitive method in order to answer the following question: what are the reasons that made imprisonment the punitive method par excellence? Although the Enlightenment discourse that took over the reformist penal movements of the 18th century contributed to the adoption of imprisonment, an analysis based on the concepts of critical criminology demonstrates that imprisonment became the punitive method par excellence due to its adherence to the capitalist mode of production.
