The article is aimed at disclosing the implementation of alternative ways of resolving legal disputes and conflicts. It is substantiated that the search for alternatives to state courts for resolving disputes is due to the following factors as the legal awareness of society, the state, legal culture, clear legislation, the adoption of valid court decisions, the structure of the judicial system, the effectiveness of its work, the level of development and complexity of economic and other public-legal relations.
Alternative dispute resolution procedures include extrajudicial and conciliatory dispute resolution measures. European law distinguishes between five types of out-of-court dispute resolution procedures: arbitration, the involvement of a labor inspector or ombudsman, reconciliation, mediation and out-of-court ADR (alternative dispute resolution instruments involving social partners). The authors conclude that ADR is used in many European countries, but there are country-specific nuances in its application. Alternative dispute resolution procedures can take place at any stage of litigation, but it is important to choose one that meets the interests of both parties in order to ensure the fastest, most effective and inexpensive dispute resolution.
