Given the serious environmental effects that can result from wildfires, criminal law also seeks to prevent them through various forms of criminal offences. These include the crime of setting fire to woodlands or forests (article 354.1 of the Spanish Criminal Code), regarding which there is an ongoing debate among scholars — but not in its jurisprudential interpretation — about its legal nature, specifically whether or not it constitutes a genuine crime of forest arson. The answer to this question has significant practical consequences: on the one hand, because it affects the explanation of the iter criminis in forest arson offences; and, on the other hand, because it also has implications for how to interpret the provision that generally criminalizes offences of serious reckless/negligent burning (article 358 of the Spanish Criminal Code). The thesis that will be defended here will propose an interpretation that takes into account both dogmatic and political-criminal methods; from this second perspective through the consideration of the legitimizing and limiting principles of the State’s punitive power.
