Although all members of society seek to interact freely with one another in order to exercise their respective rights simultaneously and peacefully, conflicts are sometimes inevitable in this endeavor. The right to the inviolability of the home (art. 18.1 and 18.2 CE), a healthy enviorenment (art. 45 CE) and the exercise of freedom of enterprise (art. 38 CE) may be completely incompatible when exercised simultaneously if the activity of the latter generates an intrusion into the former that makes its peaceful enjoyment impossible. Noise pollution generated by nightlife becomes an invasive external agent that prevents and/or limits the exercise of freedom, intimacy, and private life of those living in homes adjacent to the noise source. With the aim of protecting their health, their right to rest, their intimacy, and their private life, as well as, the environment in general, a group of citizens from the city of Malaga (historic city center and Teatinos) have managed, not without effort and overcoming obstacles of all kinds, to have several streets in their respective residential areas declared acoustically saturated areas (Z.A.S.), thus resulting in the application of restrictive measures on the polluting source (activities that generate nightlife) that will improve their quality of life. Despite not being satisfied with the outcome, they continue to fight for the Administration to extend that already declared Z.A.S. designation and, furthermore, to tighten the measures initially agreed upon therein.
