This article analyzes the material and internal activity of the Administra-tion as a substantive precondition for the development and implementation of administrative procedure in continental legal systems, with particular emphasis on public procurement. Consistent with this premise, administrative law scholarship has traditionally focused on formalized legal instruments – regulations, administrative acts, and public contracts – and on the mechanisms governing their review, while relegating the study of those internal actions that are not procedurally formalized and that precede and shape administrative decision-making. Against this backdrop, the article argues that the internal activity of the Administration does not constitute a marginal or legally irrelevant manifestation, but rather an inherent dimen-sion of the exercise of public power that performs a structural function in the configuration of administrative procedure
