The essay analyses the evolution of the principle of the primacy of EU law in its relationship with the domestic law, through the case law of the Court of Justice and the Italian Constitutional Court. After reconstructing the Granital doctrine, the broadening of the concept of directly applicable provisions, and the constitutional changes concerning Articles 11 and 117(1) of the Constitution, the essay focuses on the consequences of the Treaty of Lisbon and on the significance acquired by the obiter dictum of 2017 in cases of dual conflict. Particular attention is devoted to recent judgments in the fields of labour law and social security, in order to assess how the Constitutional Court is redefining the relationship between the disapplication of domestic law, constitutional review proceedings, and the protection of rights.
