This work describes and analyses the constitutional configuration and the legal-juridical regime of the Public Prosecutor's Office in Spain, as promoter and advocate of the action of justice, defender of the social interest, of the current legality and of the rights of the citizens.
The historical context of the institution has developed since ancient times, with the appearance of the first civilizations that laid the foundations of the current democratic States, from the Egyptian era through the Greek and Roman era, and from the Middle Ages to the present day. The result of this will be the legal breakdown in defense of the public interest, with various divergent models according to the passage of time, which, at the beginning of history would be those of the Monarch, to later mutate into the procurement of the interest of the Nation, then in the Cortes Generales with the King, and finally, evolving into the defense of the fundamental rights and freedoms and general interests of the citizens, having as an example of all this, the sovereignty vested in the Spanish people. Thus, the General Prosecutor's Office was born in 1713, during the reign of Philip V. It would be the Provisional Law of the Judiciary of 1870 that would align the members of the Public Prosecutor's Office with those of the Judicial Power, providing them with greater independence and professionalism, modernizing the Administration of Justice.
With the transcendental arrival of the Spanish Constitution of 1978, the Public Prosecutor's Office would be provided with autonomy and functional integration within the Judicial Power, further expanding its powers, functions, organization and structure, complementing the development of its responsibilities through the Organic Statute of the Public Prosecutor's Office of 1981. In conjunction, the normative development not only in its constitutional and statutory bases, but with the rest of the provisions present in the legal system, will see its actions expanded through the principles that inform it: organization, unity of action, dependence, and hierarchy.
In addition to being instrumentalized in those inherently by the general principles of legality and impartiality.
The Public Prosecutor's Office intervenes in all jurisdictional orders and is present before the main organs of the State due to its status as an autonomous institution, promoter of the action of justice and defender of the rights of citizens and of legality by controlling their compliance with it. It is also the guarantor of the prosecution and bringing before the Judiciary the knowledge of criminal commissions through accusation. With the signature of Spain on October 12, 2017 through reinforced cooperation, the European Union Prosecutor's Office arises, with which it will work hand in hand applying both Union and National Law, with the objective and mission of promoting the action of justice when economic and financial crimes are committed that affect the European Union.
In short, the Public Prosecutor's Office plays a necessary and indispensable role in guaranteeing authentic compliance with the Constitution and the laws
