La Fundación Ciudadana Civio, tras una larga batalla procesal, consiguió acceso al código fuente de la aplicación Bosco. El acceso le había sido negado al amparo del artículo 14 de la Ley 19/2013, de 9 de diciembre. El Tribunal Supremo resolvió la tensión del acceso reconocido en el artículo 105.b de la Constitución española y los límites legales del artículo 14 de la Ley 19/2013 mediante una operación hermenéutica constitucional de primer orden, en línea con la lógica de la transparencia algorítmica consagrada en la Carta de Derechos Digitales.
The Fundación Ciudadana Civio, following a protracted legal battle, gained access to the source code of the Bosco application. Access had been denied under the protection of Article 14 of Law 19/2013, of 9 December. The Supreme Court resolved the tension between the access right enshrined in Article 105(b) of the Spanish Constitution and the legal limits of Article 14 of Law 19/2013 through a constitutional hermeneutic operation of the first order, aligned with the logic of algorithmic transparency set forth in the Digital Rights Charter.
