The purpose of this study is making a series of reflections that, supported by a legal foundation of the matter, seek a pragmatic approach to analyze the socioeconomic effects that are - and will continue to - occur due to the ever-increasing progress of telematics. Specifically, it aims to raise the debate on whether the incentivization of the unstoppable development of increasingly frequent elements such as Artificial Intelligence (“AI”) is justified by its advantages in the automation of processes, even when the inputs from which it is nourished generate revenues for third parties that may be affected, or whether, on the contrary, it is not justified or should be done with a more proportionate approach. It also wishes to shed light on cutting-edge legal issues resulting from these social advances, given their pecuniary relevance and interference in legal ownership regimes.
