The conclusion of the agreement between MERCOSUR and the European Union established a particular legal framework with the approval of two agreements: an Association Agreement (hereinafter, AA) that integrates political dialogue, cooperation, and the commercial pillar, and, on the other hand, an Interim Trade Agreement (hereinafter, ITA) intended to allow the provisional application of the commercial pillar under the exclusive competence of the Union. This requires the coordination of instruments with different regulatory logics—trade, cooperation, and political values—with the particularity that a single judicial forum for disputes is not created. The article analyzes, based on the AA (EMPA) and the ITA (ITA), the unified trade dispute settlement procedure, the Trade and Sustainable Development chapter, and the possible options for conflicts arising from the political dimension of the Agreement, such as a democratic breakdown.
