This paper analyzes the mining extraction model in Peru from a socio-environmental and human rights perspective, in light of international law and the inter-American system. Taking a critical approach, it examines the tension between economic development and the protection of the environment and the rights of indigenous peoples. It also examines the applicable international and national regulatory framework, as well as the relevant jurisprudence of the Inter-American Court of Human Rights, particularly regarding the obligations of prevention, prior consultation, and free and informed consent. Finally, emblematic socio-environmental conflicts are briefly analyzed to show the gap between recognized legal norms and their effective application, highlighting the need for an approach to sustainability centered on human dignity.
