This study examines the draft articles of the International Law Commission (ILC) on the prevention and punishment of crimes against humanity from the perspective of the integration of a gender dimension. In particular, it analyses the exclusion of the restrictive definition of «gender» contained in Article 7(3) of the Rome Statute of the International Criminal Court (ICC) and its implications for an evolutionary interpretation of international criminal law. It also addresses the debate surrounding the possible autonomous criminalization of so-called «gender apartheid» as a crime against humanity within the framework of a future treaty, starting from the traditional conception of the crime of apartheid as linked to the racial element and exploring its projection onto other forms of institutionalized oppression, such as the policies of segregation and exclusion imposed on women and girls in Afghanistan.
