This article seeks to determine the role of the Security Council (SC) in implementing the norms of the nuclear non-proliferation regime comprised of the Non-Proliferation Treaty (NPT), the IAEA Statute, and the safeguards agreements. Specifically, it seeks to demonstrate that the SC has powers to enforce the regime when breaches of that regime endanger international peace and security, and that these powers are based on the Charter of the United Nations and recognized in the norms of the regime. To this end, the SC’s powers related to the implementation of the nuclear non-proliferation regime are examined, both those recognized in its norms and those that may be derived from the Charter of the United Nations. The importance of Article 26 of the Charter as a provision conferring functions on the SC in matters of disarmament and arms regulation is highlighted, as is the SC’s primary responsibility for the maintenance of international peace and security, emphasizing the SC’s determination of the proliferation of weapons of mass destruction as a threat to peace, as the basis of the SC’s powers in this area. It is argued that the NPT implicitly recognizes a role for the SC, and its powers under the IAEA Statute are analyzed. These include the Agency’s duty to notify the SC of situations falling within its competence, in Article III.B.4 (applied in the case of Iran’s nuclear program), and the obligation of the Board of Governors to report non-compliance with safeguards, in Article XII.C. The article concludes that these provisions do not add new functions to the SC, but rather confirm the powers it has under the Charter.
