Es difícil determinar con precisión el confuso régimen de ineficacia previsto para los contratos celebrados por las personas con discapacidad que necesitan apoyos en el ejercicio de la capacidad jurídica, cuando actúen sin los mismos. El trabajo se acerca a las posibles interpretaciones de los preceptos aplicables reflexionando sobre cuál o cuáles parecen más adecuadas, teniendo en cuenta la intención del legislador y la coherencia del sistema. Se plantea, también, la impugnación de los contratos celebrados por quien no cuenta con apoyo,pero lo necesita;de los negocios realizados por quien presta el apoyo sin autorización judicial cuando es preceptiva y la realización de testamento por las personas con discapacidad.
The possible interpretations of the regulation that allows for the challenge of contracts entered by peoplewith disabilities who are provided with support in exercising their legal capacity when acting without it are revised. The possibility of challenging contractsenteredby people without support, but who need it, legal businesses executed by those who provide support without judicial authorization when necessary, and the granting of willby people with disabilities who need support in decision-making are also being studied.
