El estudio versa sobre el tratamiento que se da a la institución de la legítima en el Código Civil Peruano de 1984, vigente en la actualidad; haciendo una breve evolución histórica de ella a través de los códigos civiles existentes en la vida republicana de dicho país, se aborda su naturaleza jurídica, la intangibilidad de esta en el ordenamiento existente, la forma en que es determinada, así como las personas consideradas como legitimarias, del mismo modo se comentan otros derechos que tienen conexión y afectan la legítima de una parte de los herederos en beneficio de otra, explicando la razón de dicha situación.
This study deals with the treatment given to the insti-tution of the legitimate portion in the Peruvian Civil Code of 1984, currently in force; making a brief historical evolution of it through the civil codes existing in the republican life of that country, its legal nature is addressed, its intangibility in the existing order, the way in which it is determined, as well as the persons considered as legitimate heirs, in the same way other rights that are connected and affect the legitimate portion of one part of the heirs for the benefit of another are addressed, explaining the reason for this situation.
