Directive 2019/1937 and Spain’s Law 2/2023 establish a whistleblower protection framework that combines positive and ne-gative scopes, resulting in complexity and fragmentation. The Spa-nish transposition broadens coverage to national infringements but creates a double threshold that may undermine coherence and legal certainty. The personal scope is broad, yet requires flexible interpre-tation to include groups such as senior officials or harassment cases not clearly covered by the text. In this context, the “reasonable belief” standard plays a crucial role, ensuring protection for well-founded reports even if unsuccessful, while excluding abusive or malicious disclosures. It thus becomes the core element that guarantees both effectiveness and balance of the system.
