This paper aims to highlight the contribution made in the field of this specialization, in order to ultimately fulfill the doc-trine of the TEDH and, thereby, restrict Military Justice within the regulatory framework of the Spanish Constitution in its articles 8 and 117 to the strictly military sphere. Accordingly, it is clear that Mi-litary Justice cannot adjudicate civil offenses committed by civilian offenders based on the ruling of the Full Constitutional Court, num-ber 128/2024, of october 22. However, the issue cannot stop there; we must take one step further, as this contribution aims, to achieve the total expulsion of the civilian offender from the military crimes clas-sified in the Military Penal Code.
