Aunque a veces se cuestiona el uso de mapas y guías históricos como medio para acreditar, a través de indicios, o para probar la titularidad de los caminos públicos, la jurisprudencia española ha avalado, e incluso subrayado, reiteradamente la importancia y el valor probatorio de dichos documentos, especialmente cuando fueron producidos por instituciones oficiales sobre una base legal o normativa. En este artículo se describe el origen y el desarrollo de los documentos de referencia más significativos en este ámbito.
Although the use of historical maps and walking guides as a means of establishing, through circumstantial evidence, or proving ownership of public roads and rights of ways is sometimes objected, Spanish jurisprudence has repeatedly endorsed, and even emphasized, the importance and probative value of such documents, especially when they were produced by official institutions on a legal or regulatory basis. This article describes the origin and development of the most significant reference documents in this area.
