    Esta investigación analiza las posibilidades de autodeterminación que se confieren a la persona trabajadora en aquellos supuestos de riesgo grave e inminente contemplados en el artículo 184 bis del Código del Trabajo. En tal sentido, se examinan los supuestos de hecho contenidos en la precitada norma, luego se formulan y justifican las similitudes distinciones entre la desobediencia laboral y el ius resistentiae. Finalmente se delimitan los campos de acción en los que opera cada uno de estos institutos.

    This research will analyze the scope for self-determination afforded to workers in cases of serious and imminent risk as set out in Article 184 bis of the Labor Code. In this regard, the factual scenarios contained in the aforementioned provision will be analyzed; subsequently, similarities and distinctions between industrial disobedience and the ius resistentiae will be identified and justified; and finally, the scope of application of each of these legal concepts will be defined.
