Sabe-se que o uso da tecnologia é uma realidade há décadas e que essa presença tecnológica tende a continuar crescendo. No âmbito artístico, a tecnologia atua como uma ferramenta, muitas vezes fundamental, para a concepção de uma obra. No tocante à inteligência artificial, infere-se que o detentor dos direitos autorais com relação àquela produção é aquele que, com o auxílio desse software, produziu a arte. Entretanto, como discorrer sobre a propriedade intelectual de algo que foi produzido por uma inteligência artificial autônoma? De que modo isso interfere no Direito? A presente pesquisa intenciona-se, pois, propor tais questões. Visa-se, mediante essa, discorrer sobre as inovações da inteligência artificial, de modo a investigar os impactos disso no Direito e na compreensão do que se entende pela expressão “propriedade intelectual”, compreendendo de que modo a evolução tecnológica exige do Direito o aperfeiçoamento e a compatibilidade para com a sociedade contemporânea. A arte acompanha a vida e é necessário compreender isso para que o Direito escrito não se torne, citando Ferdinand Lassalle, apenas mais uma mera “folha de papel” que não corresponde à sociedade a qual expressa.
It is known that the use of technology has been a reality for decades and that this technological presence tends to continue growing. In the artistic sphere, technology acts as a tool, often essential, for the conception of a work. Regarding artificial intelligence, it is inferred that the copyright holder of aproduction is the one who, with the help of this software, produced the art. However, how to talk about the intellectual property of something that was produced byautonomous artificial intelligence? How does this interfere in Law? The present research intends, therefore, to propose such questions. The aim is, through thisresearch, to discuss the innovations of artificial intelligence, in order toinvestigate the impacts of this on Law and on the understanding of what is meant by the expression "intellectual property", understanding how technological evolution requires the improvement of Law and compatibility with contemporary society. Art accompanies life and it is necessary to understand this so that written Law does not become, quoting Ferdinand Lassalle, just another “sheet of paper” that does not correspond to the society that is expressed by the law.
