En el presente artículo se realiza un estudio analítico y jurisprudencial sobre la incidencia de la automatización del proceso judicial colombiano mediante el uso de inteligencia artificial, con respecto al principio de imparcialidad, buscando esclarecer dichos conceptos y desmentir ciertos mitos con relación a la utilización de sistemas algorítmicos y su trasgresión de principios constitucionales y procesales, pese a la necesidad de crecimiento y avance tecnológico que requiere el sistema judicial, como consecuencia de la falta de celeridad y actualización. De manera que para su realización se acudió a una metodología de carácter teórico y analítico, que permitió dar como principales resultados que la IA como herramienta si bien tiene un margen de imparcialidad dependiendo como se automatice y se aplique al proceso, el deber ser es que este sea lo más mínimo posible. Por ello se concluye dando respuesta a la problemática que la voluntad de la automatización de la misma está estructurada de conformidad con el ordenamiento jurisdiccional y la vida en sociedad
In this article, an analytical and jurisprudential study is carried out on the incidence of the automation of the Colombian judicial process through the use of artificial intelligence, with respect to the principle of impar-tiality, seeking to clarify these concepts and deny certain myths in relation to the use of algorithmic systems and its transgression of constitutional and procedural principles, despite the need for growth and technologi-cal progress required by the judicial system, as a consequence of the lack of speed and updating. So, for its realization, a theoretical and analytical methodology was used, which allowed to give as main results that AI as a tool, although it has a margin of impartiality depending on how it is automated and applied to the process, the duty to be is that this sea as minimal as possible. For this reason, it is concluded by responding to the problem that the will to automate it is structured in accordance with the jurisdictional system and life in society.
