Esta laguna jurídica exige articular nuevas herramientas jurídicas y el diseño de mecanismos legales innovadores que realmente protejan el futuro escenario de la vida. Se requiere un cambio de paradigma que articule nuevos instrumentos eficaces para proteger no sólo los derechos de las generaciones futuras, sino la vida futura del planeta
Contemporary law faces the challenge of incorporating an intergenerational perspective that ensures sustainability and equity between present and future generations. Intergenerational justice raises fundamental questions about how to balance a clearly asymmetric situation between the rights of the present and the expectations of the future. This legal gap requires the development of new legal tools and the design of innovative mechanisms that genuinely protect the future state of life. A paradigm shift is needed to establish new, effective instruments that protect not only the rights of future generations but also the future life of the planet
