La mayor concienciación y, en consecuencia, exigencia social de proteger a la infancia también en el ámbito digital se ha trasladado al marco regulatorio nacional y europeo a través de diferentes normas e instrumentos. Entre ellos, el más significativo está siendo el de la «determinación» de la edad. Sin embargo, lejos de ser pacífica la introducción de mecanismos capaces de discriminar el acceso a los contenidos en internet o a las redes sociales, la posibilidad de afectar gravemente derechos o intereses de terceros, o incluso la seguridad de los datos y de su tratamiento, está comprometiendo seriamente el éxito de esta pretensión.
The rise in awareness and, consequently, in the societal demand to protect children in the digital sphere has been reflected in both the national and European regulatory frameworks through various legal instruments. Among these, the most prominent has been the issue of age assurance. However, the introduction of mechanisms capable of restricting access to online content or social media platforms is far from uncontroversial. The potential to severely impact the rights or the interests of third parties, or even the security of personal data and its processing, is significantly jeopardizing the success of this initiative.
